Andsafe DE Affiliate Program

Basics

In order to be connected to the program you are required to have a working website with good performance and a decent amount of traffic, or a proven community on social media. Otherwise, the application will be declined. If you were declined but think you are eligible to work with the program and can showcase your business model, please drop us an email at d.bogdanovych@admitad.com so that we can discuss it further.

The andsafe partner program is carried out by andsafe AG, Wienburgstrasse 207, 48 Münster (called andsafe or party). You (referred to as a partner, partner company or party) can participate in this affiliate program under the following conditions. These conditions apply in addition to the current conditions of Admitad.

1. andsafe affiliate program

1.1. Participation in the andsafe affiliate program

By accepting your application via the Admitad platform, andsafe entitles you to participate as a partner in the andsafe partner program. As an affiliate in the andsafe affiliate program, you are entitled to advertise and market the andsafe Services on the affiliate websites (see Clause 11) using marketing materials provided by andsafe. Details can be found in the program description at Admitad.

1.2. Tipstership

The partner acts as a tipster for andsafe. The activity of a tipster is limited to naming options for concluding insurance contracts or establishing contacts with a potential policyholder or insurance company. The activity as a tipster does not constitute insurance brokerage and does not require authorization (no entry in https://www.vermittlerregister.info/). The in section 2.1. The agreed restrictions must be observed throughout the partner's activity.

1.3. No subcontracts

Unless andsafe agrees in writing in advance, you have no right to authorize any other person, partnership or entity to advertise or market andsafe Services or pass on any other right or obligation under the Terms.

1.4. No exclusivity

You acknowledge and agree that you do not have the exclusive right to advertise or market the andsafe Services.

1.5. Effective Date

The effective date of these Terms is the date on which andsafe accepts your application to the andsafe Affiliate Program (the "Effective Date").

2. Partner's Obligations

2.1. You act as a tipster and must observe the following:

The tip is limited to the transmission of
              (a) Contact details of interested parties and

              (b) general information about the interest expressed (e.g. product category) with the consent of the interested party to andsafe.

2.1.1. The partner company is not authorized to advise customers on the insurance product offered

The partner company is not entitled to act as a representative for andsafe, i.e. in particular it may not act on behalf of andsafe and may not make or accept any legally binding declarations for andsafe
The Partner may not aim for the submission of a specific declaration of intent by a prospective customer to conclude an insurance contract or obtain applications related to an insurance product; i.e. it may only refer generally to the insurance company and to a product category.
In addition, the partner company must observe the more detailed regulatory explanations for tipsters in letter B.VIII of circular 11/2018 and in letter C.I of the leaflet on the interpretation of the special remuneration ban (§ 48b VAG) of the Federal Financial Supervisory Authority -BaFin.
If you are a natural person, you are obliged to obtain a secondary activity permit before starting cooperation in accordance with the legal requirements and this must also be submitted to the insurance company or insurance intermediary.

2.2. You will comply with (a) all applicable laws, rules and regulations, and (b) all quality and marketing policies of andsafe, and (c) periodically visit the andsafe website and the andsafe Affiliate Program Description for changes in policies and procedures.

2.3. You will, in good faith, use commercially reasonable efforts to advertise and market the andsafe Services to customers in a manner consistent with andsafe's reputation, goodwill and reputation. In doing so, you will not knowingly: (a) make false or misleading representations about andsafe or andsafe Services to customers and/or third parties; or (b) make any representations, warranties or guarantees with respect to andsafe Services.

2.4. You may only use the provided marketing materials to promote the andsafe Services and only in accordance with the Terms and Program Description or other brand identity guidelines.

2.5. You will promptly identify to andsafe the domain name(s) of any Affiliate Sites in existence at the Effective Time. If you set up new partner websites, you are obliged to inform andsafe immediately and to identify the entire domain of the partner website.

2.6. You will not use any third party trademarks, names or related terms, or use our brand name "andsafe" and/or its misspellings to conduct performance marketing using keywords or advertise such terms in pay-per-click advertising or on search engines or social platforms use.

2.7. If andsafe informs you about non-compliance of the partner website, you are obliged to make necessary changes immediately after receiving notification from andsafe.

3. Restrictions on Marketing Activities

3.1. The affiliate website, affiliate email/newsletter or other media used to promote the andsafe services may

do not defame, disparage, threaten or harass any other person, nor contain third-party personally identifiable information (such as names or email addresses).
do not violate any intellectual property rights of third parties, such as copyrights, trademark rights, naming rights or other proprietary rights
not be misused for spam, advertising of any kind or other commercial interests or to incite political protests
and contain no illegal content such as criminal, pornographic, violent, defamatory or slanderous content or harmful content such as viruses, trojans and malware
3.2. The partner website, the partner email/newsletter or other media as referred to in 3.1. must contain a legal notice (imprint) in accordance with applicable law (e.g. Sections 5 and 6 of the Telemedia Act).

4. License Grants

4.1. License for andsafe Services

During the Term, andsafe hereby grants you a non-exclusive, non-transferable, non-sublicensable, royalty-free and limited license to use and display Marketing Materials as necessary to fulfill your obligations under these Terms. For the purposes of these Terms, andsafe will provide you with the Marketing Materials in an industry standard media format.

4.2. License Restrictions

You may only use marketing material created and provided by andsafe to promote the andsafe Services. You may not alter or edit any marketing material without andsafe's prior written consent.

4.3. No Implied Licenses

Except for the license granted herein, no other right or license under these Terms is granted under any intellectual property right owned or licensed to either party, whether by implication, estoppel or otherwise.

5. Compensation

5.1. You are entitled to compensation per validated sale (tipper commission). A sale is an online transaction by a customer that results in the conclusion of an insurance contract with andsafe. A sale requires that the respective customer

accesses the andsafe website via the partner website
concludes an insurance contract with andsafe and
has not canceled or otherwise terminated (e.g. contested, revoked) the insurance contract within 30 days of the insurance contract coming into effect.
The amount of the commission is regulated by the applicable commission model and contractually agreed with each partner in the Admitad system
5.2. andsafe will confirm and validate each sale within 30 days of signing the insurance policy. Compensation will be automatically paid by Admitad once andsafe has confirmed the sale.
